Welcome to ScaleFair. These Terms of Service ("Terms") set out the rules that apply when you use any of the services provided by ScaleFair Ltd ("ScaleFair", "we", "us", or "our"). By accessing or using our services, you agree to these Terms. If you do not agree with any part of them, please do not use our services.
Our services are available only to individuals aged 18 or over who are legally capable of entering into contracts. If you meet this requirement, you are welcome to create an account and use our platform.
We provide website hosting, domain registration and transfer services, productivity tools such as Google Workspace and Microsoft 365, and enhanced security features including SSL certificates, DDoS protection, and malware scanning. A full description of our services is available on our website and may evolve over time. Certain services may be subject to eligibility requirements, technical limitations, or geographic availability. Some services may be delivered in part by third-party providers, and we are not responsible for changes to their terms, policies, or service availability. Collectively, these are referred to throughout these Terms as the "services."
When you register for an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Keeping your account information up to date and secure is your responsibility.
You must not use our services for any unlawful purpose, to harass others, to host malicious content, or to disrupt our infrastructure. Unauthorised access attempts or violations of system security are strictly prohibited. For further detail, please refer to our Acceptable Use Policy. Breaches may result in immediate suspension or termination of your account.
Each hosting plan includes specified limits on storage, bandwidth, and other system resources, as outlined on our website and in your client area ("client area" refers to your secure account dashboard on our website). If your usage is deemed excessive or negatively impacts other users, we may take action including throttling, suspension, or termination of services.
We conduct daily backups for shared hosting plans using JetBackup. Customers using VPS or dedicated servers are responsible for arranging and maintaining their own backups unless otherwise agreed. While we take appropriate precautions, you are ultimately responsible for safeguarding your data.
You are responsible for the security of your applications and websites, including the management of third-party software such as plugins or themes. We provide robust server-level security, but protection at the application level remains your responsibility.
All services are billed in advance on a monthly or annual basis. Auto-renewal is enabled by default but can be disabled through your client area. Invoices compliant with VAT requirements are available in your client area. We will notify you of upcoming renewals by email. Accepted payment methods include PayPal, credit/debit card, Apple Pay, Google Pay, and bank transfer for larger transactions. Failure to pay on time may result in suspension of services.
We offer a 30-day money-back guarantee on shared hosting and other eligible services. After this period, payments are non-refundable unless required by law. Refunds do not apply to domain registrations, third-party licences, or add-ons unless otherwise stated. Please refer to our Refund Policy for further details.
We provide free website migrations for new customers, subject to eligibility and complexity. Please contact our support team for assistance.
Our customer support is available 24/7 via Live Chat, Email, Freephone, and our Ticket System. We aim to respond within 30 minutes. All customers receive equal support standards, though priority handling is offered to customers on higher-tier plans.
We aim to deliver 99.9% uptime across all services. Planned maintenance will be announced in advance. Where service availability falls short of our target, customers may request service credits at our discretion. A public status page is available for transparency. We are not liable for outages caused by upstream providers or third-party network failures.
Domains are managed through your client area. You are responsible for renewing domain names prior to their expiry. We are not liable for any issues arising from expired domains.
We may suspend or terminate your access to our services if you breach these Terms, fail to make payments, or present a legal or security risk. Where appropriate, we will attempt to resolve matters before taking action.
We may update our services and these Terms periodically. You will be given notice of significant changes at least 14 days in advance, unless immediate changes are needed for legal, regulatory, or security reasons. Continued use of our services after changes take effect constitutes your acceptance.
While we strive to provide reliable services, we are not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount paid by you in the preceding 12 months. All services are provided "as is" and "as available", without warranties of any kind.
You agree to indemnify and hold harmless ScaleFair from any claims, damages, liabilities, or expenses resulting from your breach of these Terms or misuse of the services.
We process your personal data in accordance with the UK GDPR and related legislation. For more information on how we collect, store, and use your data, please refer to our Privacy Policy available at [Insert URL to Privacy Policy].
All promotional pricing, discounts, or offers are subject to availability and may be modified or withdrawn at any time without prior notice. Eligibility for promotions is determined at our sole discretion.
